Historically, trademark law has been aimed at preventing consumers from becoming confused about the source or origin of a good or service. In other words, the law wants to prevent a person from buying a product or service, for example, a hamburger thinking it is from McDonalds when in actuality it is being purchased from an infringer McDomalds. More recently, trademark law has also begun to protect the value of a mark. This is accomplished through laws that impose penalties for diluting famous marks.
